These Terms of Service ("Terms") govern your access to and use of the Crackd application, website, and related services (collectively, the "Services") provided by Crackd ("we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
By downloading, installing, or using Crackd, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Services.
Crackd is a real-time conversation assistant that provides live transcription, contextual awareness, and AI-generated responses during conversations. The Services are designed to help users follow, summarize, and respond during conversations in real time.
The Services are provided exclusively for lawful purposes. You agree to use the Services only in compliance with all applicable local, state, national, and international laws, treaties, and regulations, including but not limited to:
You are solely responsible for determining whether your use of the Services complies with applicable laws and any agreements you are bound by. We do not provide legal advice and make no representations regarding the legality of any specific use of the Services.
You agree that you will NOT use the Services to:
Many jurisdictions require consent from one or all parties before recording or transcribing a conversation. You are solely responsible for obtaining any required consent before using the transcription features of the Services. We are not responsible for any use of the Services that violates applicable recording or wiretapping laws.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate and complete information when creating an account and to keep such information up to date.
The Services may include features that use artificial intelligence to generate text, information, analyses, and other content ("AI Output"). You acknowledge and agree that:
Certain features of the Services require the purchase of credits. By purchasing credits, you agree to pay all applicable fees. All fees are non-refundable unless otherwise stated. Credits do not expire. We reserve the right to change pricing at any time, with changes effective for new purchases only.
All rights, title, and interest in and to the Services, including all software, documentation, and content, are owned by Crackd. You are granted a limited, non-exclusive, non-transferable license to use the Services for your personal, lawful use only.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO WARRANTY REGARDING THE UNDETECTABILITY OF THE APPLICATION DURING SCREEN SHARING OR ANY OTHER SCENARIO.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRACKD, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) AI OUTPUT OR ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Crackd and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any rights of a third party; or (e) any content or data you submit through the Services.
We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the Services after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in India.
